Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent to conduct survey and fix the boundaries of the petitioner's land measuring to an extent of 0.11.00 Ares comprised in Survey No.283/4B1 (Old S.No.283/4) and land measuring to an extent of 0.11.00 Ares comprised in Survey No.283/5B1 (Old S.No. 283/5) both the lands are situated at Pullambadi Village, Lalgudi Taluk, Thiruchirappalli District and consequently direct the respondent to subdivide the property and to issue Individual Patta in favour of the petitioner by considering the petitioner's application, dated 19.02.2024 within a time to be stipulated by this Court.

O R D E R

The petitioner has made an application for survey on 19.02.2024 and for issuance of separate patta subsequent to the said survey.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondent.

3. The case of the petitioner is that, the petitioner's father and his brother entered into a partition deed and divided joint properties. Subsequently, the petitioner's father has settled his share on the petitioner in and by way of a registered settlement deed, dated 19.02.2024. It is based on this settlement deed, in and by which, the petitioner becomes entitled to the subject lands, within four boundaries, that the petitioner has sought for survey and separate patta. Admittedly, the patta still continues to stand in the joint names of the petitioner's father and uncle, though they already partitioned the properties.

4. In view of the above, this writ petition is disposed of, directing the authorities to conduct survey, after giving notice to the joint pattadhar, namely Panneerselvam, since the petitioner submits that the petitioner is not in good 2/4

terms with the said Panneerselvam and pass orders within a period of eight (8) weeks from the date of receipt of copy of this order.

5. with the above direction, this Writ Petition stands disposed of. No costs.
