O R D E R

This Criminal Original Petition has been filed seeking a direction to direct the learned District and Sessions Judge/PCR Cases, Sivagangai District, to consider the bail application of the petitioner on the same day on merits in the event of his surrender in connection with Crime No.827 of 2020 on the file of the respondent police.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2.

3.On perusal of the averments found in the petition filed by the petitioner, it appears that the First Information Report has been registered for the offence punishable under Sections 306 of https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.8813 of 2020 I.P.C and Section 3(1)(r), 3(1)(s), 3(2)(v) of SC&ST (POA) Act. 4.In this regard, the learned Additional Public Prosecutor appearing for the respondents police would submit that during the time of occurrence, due to the dispute over the immovable property, the petitioner and others abetted the deceased for commission of suicide. Only due to the act committed by the petitioner and others, the deceased went to the extent of hanging herself. 5.Now on considering the facts and circumstances of the case, since the alleged offence committed by the petitioner is very serious one, this Court is not inclined to allow this petition. 6.With the above observations, this Criminal Original Petition is dismissed.
