(MD).No.1708 of 2021 in Crl.O.P(MD).No.13954 of 2020 dated 03.03.2021, since the trial of case in S.C.No.168 of 2022 on the file of Additional Assistant Sessions Court, Dindigul in Crime No.2501 of 2020 on the file of the respondent had been concluded as acquittal. ORDER : The Court Made the following order :- This petition has been filed seeking direction to the Judicial Magistrate No.1, Dindigul to refund the amount of Rs.3,00,000/- which was deposited by the petitioner to the credit of the Crime No.2501 of 2020 based on the direction issued in Crl.M.P.(MD).No.1708 of 2021 in Crl.O.P(MD).No.13954 of 2020 dated 03.03.2021, since the trial of case in S.C.No.168 of 2022 on the file of Additional Assistant Sessions Court, Dindigul, had been concluded as acquittal.
2. According to the petitioner, he was arrayed as an accused in Crime No. 2501 of 2020. This Court, by order dated 03.03.2021 in Crl.M.P.(MD) No. 1708 of 2021, directed the petitioner to deposit a sum of Rs.3,00,000/- to the credit of Crime No. 2501 of 2020 before the trial 2/6
Court. In compliance with the said direction, the petitioner deposited the aforesaid amount.
3. The learned counsel further submitted that the petitioner faced trial in S.C. No. 168 of 2022 on the file of the Assistant Sessions Court, Dindigul and was acquitted by judgment dated 02.07.2025. However, no specific order was passed by this Court regarding the refund of the amount deposited by the petitioner. Consequently, the trial Court has not refunded the said amount to the petitioner. Hence, the present petition has been filed seeking appropriate relief.
4. On 22.04.2026, after hearing the arguments, this Court called for a report from the concerned Court regarding the amount deposited by the petitioner. Pursuant to the same, the trial Court submitted a report stating that a sum of Rs.3,00,000/- had been deposited before the Court on 10.03.2021 in compliance with the order passed by this Court in Crl.M.P. (MD) No. 1708 of 2021 in Crl.O.P.(MD) No. 13954 of 2020, dated 03.03.2021. The report further stated that no specific order had been 3/6
passed regarding the refund of the said amount and the petitioner had not filed any petition before this Court seeking refund of the deposited amount. Consequently, the amount has not been refunded.

Since the amount was deposited by the petitioner and the main case has already been ended in acquittal, this Court is of the view that the petitioner is entitled to the refund of the amount so deposited. Accordingly, this petition is allowed and the petitioner is directed to approach the learned Judicial Magistrate No. I, Dindigul, by filing an appropriate petition seeking refund of the above deposited amount. Upon such petition being filed, the learned Judicial Magistrate No. I, Dindigul, shall consider the same on its own merits and pass appropriate orders in accordance with law.
