Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the refusal check slip by its Refusal No.RFL/2 vz; ,iz rhh;gjpthsh; rptfq;if/14/2026 issued by the 2nd respondent dated 04.03.2026 and quash the same as unlawful and unsustainable consequently directing the 2nd respondent to register the sale deed dated 24.02.2026 as and when the same is presented by the petitioner. ORDER

This writ petition is filed challenging the impugned refusal check slip dated 04.03.2026.

2.Upon hearing the learned counsel for the petitioner and perusing the material records of the case, it can be seen that the petitioner's vendor Isthiyak Ahamed purchased the said property vide Document bearing No. 1048 of 2008. Pursuant to the title, now a document is executed in favour of the petitioner on 24.02.2026 and the Patta also stands in the name of Isthiyak Ahamed. However, the same is refused to be registered on the ground that after the purchase of the said Isthiyak Ahamed, there is a partition deed which is registered in respect of the very same property vide document No.4549 of 2009 and therefore, considering the same as double entry, the present document is refused to be registered. 3.

Even going by the said principle, once the property vested in Isthiyak Ahamed, thereafter once again registering the partition deed, which is the later document can only be considered as a double entry. In any event, it is for the aggrieved person to approach the appropriate civil Court and establish the title.

4.In view thereof, the writ petition stands allowed on the following terms:

(i)The impugned refusal check slip dated 04.03.2026 shall stand quashed, within a period of two weeks from the date of receipt of the web copy of the order.

(ii)The petitioner shall re-present the document and if there is no other impediment, the same shall be registered. No costs. 30.03.2026 NCC:Yes/No Ns To 1.The District Registrar, Sivagangai District, Sivagangai.
