Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to release the petitioner's lorry bearing registration No.TN28-AF-7986, Engine No.697TC56FUZ851530,Chassis No.373145FUZ725977, seized by the third respondent police, by considering the petitioner's representation dated 08.08.2020 within a time stipulated by this Court.

Heard the learned counsel on either side.

2. This writ petition was filed for securing the release of the petition mentioned vehicle. I had allowed the same since it was submitted by the respondents that the vehicle was not produced before the Court below. It appears that this was an incorrect statement made by the third respondent. The vehicle had been produced before the Court below. Therefore, the order passed by this Court on 17.08.2020, is recalled and the writ petition is dismissed.

3. Liberty is given to the petitioner to move the Court below for release of the vehicle. On receipt of such petition, the Court below shall dispose of the petition on merits and in https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.9387 of 2020 accordance with law within a period of 10 days. There shall be no order as to costs.
