ORDER

Mr.K.Mahesh Raja, learned Government Advocate takes notice for the first respondent and Mr.Mahaboob Athiff, learned counsel takes notice for the second respondent.

2. Heard Mr.T.Lajapathi Roy, learned counsel appearing for the petitioners and the learned counsel appearing for the respondents.

3. The petitioners seek for a Mandamus directing the first respondent to take on file the Form 7 submitted by the petitioners on 30.10.2015 within the time frame fixed by this Court.

4. The grievance of the petitioners is that even though such Form 7 was submitted by the petitioners, the first respondent has not taken the same on file.

5. On the other hand, the learned counsel appearing for the second respondent submitted that he has also filed Form 7 before the first respondent and therefore, the prayer sought for in this Writ Petition cannot be considered by this Court.

6. It appears that the petitioners and the second respondent are having some dispute and both of them have approached the first respondent by filing Form 7. Therefore, it is for the first respondent to consider the claim of the petitioners as well as the second respondent, after giving them due opportunity of hearing, and pass appropriate orders on merits and in accordance with law.

7. Accordingly, without expressing any view on the respective claims made by the parties, I only direct the first respondent to consider the claim of the petitioners as well as the second respondent and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

8. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is also closed.
