ORDER

Seeking to modify the particular condition imposed by this High Court in Crl.RC(MD)No. 1334 of 2025 directing the petitioner to give a bank guarantee of Rs.3,00,000/- before the learned Principal Special Judge for Narcotic Drugs and Psychotropic Substances Act https://www.mhc.tn.gov.in/judis

Cases, Madurai, this petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner finds it difficult to give a bank guarantee of Rs.3,00,000/- since the bank insist upon maintaining an account with a minimum balance of Rs.1,00,000/- which is financially impossible for him. Hence, he had come forward with this application seeking to modify the said conditions permitting him to make a fixed deposit of Rs.3,00,000/- with any Nationalised Bank.

3. Considering the above, the petitioner is permitted to make a fixed deposit of Rs. 3,00,000/- with any Nationalised Bank and produce the same before the learned trial Court. However, it is made clear that the petitioner will not be at liberty to withdraw the same till the disposal of the pending criminal case in Crime No.163 of 2025 on the file of the Prohibition Enforcement Wing Police Station, Madurai.

4. Accordingly, this petition is ordered.
