Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondent to register and release the sale deed in the petitioner's application No.TP/261327997/2026 dated 20.03.2026 in Natham land the property in Old Survey No.1402/14 in New Survey No.1651/21, to an extent of 431.25 sq.ft., sitauted at Madathupatti Village, Kadayanallur Taluk, Tenkasi District, within the time limit that may be stipulated by this Court. ORDER

This writ petition is filed for a mandamus directing the respondents to register and release the sale deed Application No.TP/261327997/2026 dated 20.03.2026 in Natham land in old Survey No.1402/14 in New Survey No. 1651/21 to an extent of 431.25 sq.ft., situated at Madathupatti Village, Kadayanallur Taluk, Tenkasi District.

2.The learned counsel appearing for the petitioner would submit that merely because the property is described as Natham, the same cannot be refused for registration. The petitioner's father purchased the said property by way of a registered sale deed dated 20.12.1995, which is registered as Document No.1096 of 1995.

3.When the matter came up for admission, the learned Special Government Pleader taking notice on behalf of the respondent would submit that in this case, the document which is claimed as the parent document No. 1096 of 1995, the same is not registered with the Sub-Registrar Office concerned.

4.In reply thereof, a photo copy of the document clearly reveals that the document has been presented and duly registered on the office of the

Veerasigamani Sub-Registrar and the Document No.1096 of 1995 is also mentioned. The petitioner has also produced the encumbrance certificate which reflects the said document number.

5.In view thereof, I am of the view that the document is registered with the said office of the Sub-Registrar, the writ petition is disposed of on the following terms:

(i)The petitioner shall present the document along with the web copy of the order within, without waiting for the certified copy of the order, within a period of two weeks from the date of receipt of web copy of the order.

(ii)Upon such presentation, the same shall be duly registered, if there is no other impediment.

(iii)No costs.
