O R D E R
This Civil Revision Petition has been filed praying to direct the learned Subordinate Judge, Aruppukkottai, to dispose of the petitioner's H.M.O.P.No.47 of 2017, within the time stipulated by this Court.
2. The Revision Petitioner, who is the husband of the respondent, has filed H.M.O.P.No.47 of 2017, before the Sub Court, Aruppukkottai, for divorce. In the said petition, the respondent has also appeared and filed counter. But the said H.M.O.P. is pending from 2017 onwards. Therefore, the petitioner has approached this Court by invoking Article 227 of the Constitution of India, to expedite the trial of said H.M.O.P and to dispose of the same, within a particular period of time.
3. I have heard the learned counsel for the petitioner without issuing notice to the respondent, since no prejudice would be caused to the respondent in this case because the petitioner seeks only a direction to expedite the trial of said H.M.O.P and to dispose of the same.
4. It is admitted that the petitioner has filed H.M.O.P. The respondent has also entered appearance and filed her counter also. The said H.M.O.P. is pending for more than one year. Therefore, I am inclined to pass the following order..
The learned Sub Judge, Aruppukkottai, is directed to hear the H.M.O.P.No.47 of 2017 on day-to-day basis, without giving any adjournments to either parties and to dispose of the same within a https://hcservices.ecourts.gov.in/hcservices/
period of two months from the date of receipt of a copy of this order. After passing the Judgment in H.M.O.P.No.47 of 2017, the learned Sub Judge, Aruppukkottai, is directed to file a report to this Court, within a period of 10 days from the date of Judgment.
5. With the above direction, this Civil Revision Petition stands disposed of. No costs.
