Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to Condone the Delay of days 51 in filing the above Civil Miscellaneous Appeal in C.M.A(MD)SR.No.51541 of 2019. Prayer in CMA(MD)SR.No.51541 of 2019:

To call for records in order in on the file of the learned Judge, Family Court, Kanyakumari at Nagercoil I.D.O.P.No.157 of 2018 dated 27.03.2019, in so far as the direction given by the learned Judge to pay a sum of Rs.10,000/- each to the minor children till they complete their education or got employment whichever is earlier and to set aside the same and allow this Civil Miscellaneous Appeal. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.D.Geetha, Advocate for the petitioner and of M/s.M.Maria Vinola, Advocate taking notice on behalf of the Respondent, the Court made the following order:- (Order of the Court was made by N.KIRUBAKARAN,J.) Heard the learned Counsel appearing for the petitioner.

2. Ms.M.Maria Vinola, learned Counsel takes notice for the respondent.

3. This Court is convinced with the reasons stated in the affidavit filed in support of this petition for condoning the delay of 51 days in filing the above Civil Miscellaneous Appeal. Accordingly, this petition is ordered.

4. The Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and print the name of Ms.M.Maria Vinola, learned Counsel for the respondent.

5. The Registry is directed to refer the matter along with C.M.A.(MD)No.450 of 2019 to the Mediation and Conciliation Centre attached to this Bench on 18.11.2010. Both the learned Counsel appearing on either side are directed to co-operate with the Mediators for mediation. Both the parties are directed to appear before the Mediation and Conciliation Centre attached to this Bench on 18.11.2020. No notice needs to be issued by the Mediation and Conciliation Centre to the parties, as both the learned Counsel appearing on either side agreed for the same date for the appearance of the parties.

6. Call the matters on 23.11.2020 along the report of the Mediation and Conciliation Centre.
