This Criminal Original Petition has been filed seeking a direction to direct the third respondent not to interfere in the civil dispute under the guise of enquiry in pursuance to the complaint given by the fourth respondent.
2.The learned counsel for the petitioner would submit that the fourth respondent had purchased the land from one Amutha, who is the sister of the petitioner. In respect of the said purchase, a civil suit is pending in O.S.No.166 of 2020 before the Sub Court, Theni. Now, the fourth respondent made a false complaint before the respondent police and based on which, the respondent police harassed the petitioner under the guise of enquiry. 3.The learned Government Advocate appearing for the respondents 1 to 3, on instructions, would submit that the brother of the petitioner namely, one Kathiravan preferred a complaint as against the fourth respondent and the same is pending for enquiry. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.8538 of 2020 He would further submit that in earlier based on the complaint given by the fourth respondent, an enquiry has been conducted and the same was closed by the respondent police after giving suitable advice for approaching Civil forum. According to him, there is no complaint pending as against the petitioner. 4.In view of the same, the respondent police is directed not to interfere with the civil dispute having by the petitioner with the fourth respondent in O.S.No.166 of 2020 on the file of the learned Subordinate Judge, Theni.
5.With the above direction, this Criminal Original Petition is disposed of.
