ORDER : The Court made the following order :- This petition has been filed to modify the condition imposed by the Special Court for trial of SC/ST(PoA) Act cases, Pudukottai directing the petitioner to appear before the Kanyakumari Police Station daily at 10.00am., and 5.00 pm., for a period of 15 days.

2. The learned counsel appearing for the petitioner would submit that the petitioner was granted bail by the Special Court for trial of SC/ST(PoA) Act cases, Pudukottai directing him to stay at Kanyakumari and report before the Kanyakumari Police Station daily at 10.00am., and 5.00 pm., for a period of 15 days. He would further submit that the petitioner is working as a daily wage and sole bread winner of the family and he is unable to comply with the conditions imposed by the trial court, thereby he has filed the present petition.

3. The learned Government Advocate(Crl.Side) appearing for the respondent would submit that taking into consideration the gravity of offence the Sessions Court has imposed the condition and thereby he seeks dismissal of the petition.

4. Heard both sides and perused the materials available on record.

5. Considering the reasons stated in the affidavit and condition imposed by the Sessions Court directing the petitioner to stay at Kanyakumari and report before the Kanyakumari Police Station daily at 10.00am., and 5.00 pm., in onerous. In view of the same this Court is inclined to modify the condition directing the petitioner to appear before the respondent police daily at 10.30a.m., for a period of thirty days.
