ORDER : The Court Made the following order :- The petitioner, who apprehending arrest at the hands of the respondent Police for the alleged offences punishable under Sections 147, 148, 341 and 302 I.P.C., in Crime No.729 of 2016, on the file of the respondent Police, seeks anticipatory bail. 2.

Heard Mr.R.Gandhi, learned counsel appearing for the petitioner and Mr.A.P.Balasubramani, learned Government Advocate (Criminal Side) appearing for the State.

3. The learned counsel for the petitioner submitted that the petitioner's name does not find place in the F.I.R.; he is a College student; there is no overtact alleged as against the petitioner and therefore he prays for anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) strongly objected to grant anticipatory bail to the petitioner by contending that the date of occurrence is 22.04.2016; the petitioner attacked the deceased with stone; out of twelve accused five accused alone surrendered and the investigation is at preliminary stage.

5. Taking into consideration the overtact attributed against the petitioner and the fact that the investigation is at preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner.

In the result, this criminal original petition fails and it is dismissed.
