PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the Additional Mahila Court, Madurai, to complete the trial and dispose of the case in C.C.No.572 of 2020 within the period that may be stipulated by this Court.

ORDER

This petition has been filed seeking a direction to the Additional Mahila Court, Madurai, to complete the trial and dispose of the case in C.C.No.572 of 2020, within the time stipulated by this Court.

2.The petitioner is the defacto complainant in the criminal case. The grievance of the petitioner is that case is of the year 2018 and final report was also filed in 2020 itself. Inspite of that, no progress is made in the proceedings. Even on the earlier occasion, she has filed a direction petition in Crl.O.P.(MD)No.2258 of 2020 to complete the investigation and to file final report and an order was also passed to file final report. Only based upon that order, final report was filed by the police. Inspite of receipt of summons, the first and fourth accused have not appeared before the concerned Court. Since it is a matrimonial dispute between the husband and wife, the possibility of settlement can also be arrived by the trial Court after the appearance of the first and fourth accused.

3.Since it is a matrimonial dispute, there shall be a direction to the Additional Mahila Court, Madurai, to complete the trial process, within a period of six months from the date of resumption of regular work in subordinate Courts in view of the present pandemic situation and in the meantime, the concerned Magistrate shall also consider the possibility of settlement between husband and wife by referring the matter to the mediation. https://hcservices.ecourts.gov.in/hcservices/ 1/2
