To setaside the Judgment and Decree of the Lower Appellate court dated 04.01.2017 passed in A.S.No.4 of 2013 on the file of the I Additional District Judge, Thoothukudi, reversing the Judgment and Decree of the Trial Court dated 02.01.2013 passed in O.S.No.91 of 2007 on the file of the Sub Judge, Thoothukudi. ORDER :This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.SARAVANAN, Advocate for the petitioner, the court made the following order:- This petition is filed to condone the delay of 376 days in representing the above second appeal.
2.Heard the learned counsel appearing for the petitioner as well as the learned counsel for the respondents. 3.This Court is satisfied with the reasons stated in the affidavit filed in support of the petition to condone the delay of 376 days in representing the above second appeal. inordinate, the delay is condoned on condition that the petitioner pays Rs.2000/- (Rupees Two thousand only) to the Hon'ble Chief Justice relief fund within a period of two weeks from today. 4.Registry is directed to number the second appeal, if the papers are otherwise in order.
