O R D E R
The petitioners seek for a Mandamus directing the respondent to register and deliver the Sale Deed executed under Document Nos.P201500095 and P201500096, dated 14.10.2015 respectively, to the petitioners within a stipulated time.
2. Mr.K.Maheshraja, learned standing counsel takes notice for the respondent.
3. By consent, the writ petition itself is taken up for final disposal.
4. The learned counsel appearing for the petitioners submitted that though the two documents viz., Document Nos.P201500095 and P201500096 submitted by the petitioners were registered on 14.10.2015, https://hcservices.ecourts.gov.in/hcservices/ they are kept pending. According to the petitioners, it is not known on what reason they are kept pending and in spite of efforts, the respondent
did not deliver the Documents. Therefore, the petitioners made a representation dated 21.11.2015 requesting the respondent to deliver the above said two sale deeds executed on 14.10.2015. It is submitted that they are prepared to deposit / pay any excess amount if any required for registration. Since there is no response to the representation dated 24.11.2015, the petitioners are before this Court.
5. The learned counsel appearing for the respondent would contend that there was some technical objection for that it was kept pending. Now, the respondent will consider the representation of the petitioners and pass appropriate orders as expeditiously as possible.
6. In view of the limited scope of the prayer, without expressing any opinion on the merits of the issue involved, the respondent is directed to pass appropriate orders on the representation of the petitioners dated 21.11.2015 on merits and in accordance with law, after giving notice to the interested parties, if any, within a period of three weeks from the date of receipt of a copy of this order. This order should not be construed as giving any positive direction to the respondent and the respondent pass orders, independently, depending on the facts and circumstances of the case.
7. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
