For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.312 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Section 25(1A) of the Arms Act, in Crime No.312 of 2021, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 09.06.2021/10.06.2021 at about 00.30 hours, the defacto complainant heard the barking sound of dogs and came out. The defacto complainant, her sister, father and mother saw two persons, who were coming in a two wheeler bearing registration No.TN61-F-5343, had a country made pistol. CRL OP(MD). No.7767 of 2021 came to hunt wild animals and they had licence for possessing gun. When the persons nearby viz., Murugesan and Muthukali came there and tried to inform the police, that two persons had thrown the country made pistol and escaped from there and therefore, this case came to be registered.
3. The learned Counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case.
4. The learned Government Advocate (Crl.Side) appearing for the State opposed this petition on the ground that the investigation is not yet completed.
5. Considering the facts and circumstances of the case and considering the fact that the case was registered only on 09.06.2021 and the investigation is in preliminary stage and pending, this Court is not inclined to grant anticipatory bail to the petitioners.
