Advocate ( Crl. Side) IN ALL THE PETITIONS PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner has been implicated in as many as eleven cases. He apprehends arrest at the hands of the respondent Police for the offences under Sections 147, 148, 188, 353, 436 and 506 (ii) of I.P.C and Section 3 and 4 of Tamil Nadu Public Property (Prevention of Damages and Loss) Act in Crime Nos.
2018. The petitioner is said to have erstwhile organizer of Anti Sterlite Movement. The petitioner has not played any role at all as far as organising the recent movement for closure of the Sterlite Company.
2.The petitioner is however filed Public Interest Litigation before this Court, seeking permission to conduct memorial function. It appears that this had attracted the attention of the Police. Since in any event, the petitioner has been implicated in quite a few cases, he is directed to appear before the respondent for a period of seven days daily at 10.30 a.m.
3.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Thoothukudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police for a period of seven days daily at 10.30 a.m. and thereafter as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 4.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
