O R D E R

This Writ Petition has been filed seeking to quash the order passed by the second respondent in C.No.10/Siruganur D5 PS/2025, dated 01.04.2025and to direct the respondents to provide police protection and permission to conduct Adal Padal Programme on 04.04.2025 at about 08.00 PM to 12.00 PM in the event of the Arulmigu, Sri Alagu Muthu Mariamman Kovil Kumbabshikegam at Reddimangudi Villgae, Lalgudi Taluk, Trichy District.

2.According to the petitioner, he is the one of the members of the committee for the said temple. They have decided to conduct festival from 27.03.2025 to 04.04.2025 and also decided to conduct Adal Padal programme on 04.04.2025, for that they sent the representation dated 21.03.2025 to the second respondent and the same was rejected on 01.04.2025. Hence this petition.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the second respondent received the request from the petitioner for conduct Adal Padal Programme on 04.04.2025 and the same was rejected on the ground of law and order issue and the petitioner also sought permission for conducting Adal Padal Programme on 04.04.2025, from 08.00 pm to 12.00 P.M. He would further submit that after 10.00 p.m, no any event is permissible. Therefore, they are ready to grant permission, if the petitioner undertakes to conduct the programme without any law and order issue and conclude the same before 10.00 p.m.

4.Heard both sides and perused the records.

5.The petitioner sent the representation on 21.03.2025, but the order was passed on 01.04.2025. As per the order of the Hon'ble Division Bench of this Court in W.P(MD)No.12375 of 2023, the petitioner's representation ought to have been considered within seven days, otherwise on the eighth day it is deemed to be permitted. Therefore, the petitioner need not to file this petition. However, 3/6

challenging the order passed by the second respondent, this petition has been filed.

6.Since the second respondent has not passed the order within a period of seven days, it is deemed to be permitted. Therefore, the petitioner can conduct the festival and the cultural programme on 04.04.2025 from 07.00 pm to 10.00 pm. The second respondent is directed to give adequate police protection and monitor the entire event. The petitioner is also directed not to praise any particular community people and without any obscene acts, the programme has to be conducted.

7.With the above observations and direction, this Writ Petition is disposed of.
