PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the first respondent not to harass the petitioner in the guise of enquiry based on the complaint given by the second respondent.

ORDER

This Criminal Original Petition has been filed, seeking a direction to the first respondent not to harass the petitioner in the guise of enquiry based on the complaint given by the second respondent.

2.According to the petitioner, the complaint preferred by the second respondent is purely civil in nature. 3.The learned Government Advocate (Crl.Side) appearing for the first respondent would submit that summon has been served to the petitioner to appear for the enquiry on 03.07.2018 and the petitioner has not appeared for the enquiry on the said date. If the petitioner will co-operate with the enquiry, the same will be concluded within a period that may be stipulated by this Court. 4.The learned counsel appearing for the petitioner undertakes that the petitioner will co-operate with the enquiry as and when required.

5.Considering the above circumstances, this Court directed the first respondent to complete the enquiry on merits and in accordance with law, as expeditiously as possible, subject to the co-operation of the petitioner.
