For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.486 of 2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A.1, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 4(1)(a), 4(1-A), 4(1)(g) of Tamil Nadu Prohibition Act, in Crime No.486 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 09.06.2021, when the police party were engaged in prevention of illicit liquor, they got information that illicit liquor is being prepared on the south of Kaveri river bank. They found at about 08.00a.m., the accused were preparing illicit liquor using barrel and found 100 litres of arrack and 15 litres of illicit liquor. Therefore, this case came to be registered.

3. The learned Counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and in fact, he was taking treatment in the hospital on the alleged date of occurrence. 4. The learned Government Advocate (Crl.Side) appearing for the State opposed this petition on the ground that the investigation is not yet completed and this case was registered only on 09.06.2021.

5. Though the learned Counsel for the petitioner claimed that the petitioner was taking treatment in the hospital on the date of alleged occurrence, no material records have been filed to show that the petitioner was taking treatment in the hospital on the date of alleged occurrence. This case was registered only on 09.06.2021 and the investigation is in preliminary stage. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
