Prayer in CRL A(MD) No.77 of 2020:

To call for the records and set aside the judgment dated 12.12.2019 passed in S.C.No.369 of 2010 on the file of the Learned Sessions Judge, Magalir Neethimandaram, Madurai in the interest of justice.

ORDER : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.MUTHUSARAVANAN.C., Advocate for the petitioner and of MR.R.M.S.SETHURAMAN, Standing Counsel for State Government on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed upon the petitioner vide order, dated 28.02.2020 made in Crl.M.P(MD) No.1376 of 2020 in Crl.A(MD)No.77 of 2020.

2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this Court in Crl.M.P(MD)No.1376 of 2020 in Crl.A(MD)No.77 of 2020, dated 28.02.2020 regularly and he prayed for relaxation of the said condition.

CRL MP(MD) No.4424 of 2021 3.Mr.R.M.S.Sethuraman, the learned Standing Counsel for State Government appearing for the respondent has strongly opposed to relax the condition.

4.Taking into consideration of the submissions made by both the learned counsel, the condition imposed by this Court in Crl.M.P(MD) No.1376 of 2020 in Crl.A(MD)No.77 of 2020, dated 28.02.2020 is modified to the effect that the petitioner shall appear before the concerned Court on the first working day of every month at 10.30 a.m. until further orders.
