O R D E R

The petitioner has filed this petition to direct the respondents 1 to 4 to preserve the CCTV footage of 4th respondent police station dated 31.03.2024 based on the representation given by the petitioner dated 04.04.2024.

2. The petitioner has approached this Court that a false criminal case has been foisted by the fourth respondent and that could be established through the C.C.T.V footage recordings dated 31.03.2024, which is available in the fourth respondent police station. Therefore, this petitioner has filed this application seeking a Writ of Mandamus to preserve the C.C.T.V footage of the fourth respondent police station, dated 31.03.2024.

3. The learned Government Advocate (Crl.side) appearing for the respondents submits that based on the representation of the petitioner, already a representation has been made by the Inspector of 2/4

Police, Melur Police Station to the Superintendent of Police, Madurai , to comply the representation of this petitioner. He has also furnished a copy of the letter of the Inspector of Police, Melur, dated 22.04.2024.

4. Considering the rival submissions made.

5. Since the fourth respondent is willing to provide C.C.T.V footage and has also sought for permission from the Superintendent of Police and since this footage might be needed during the course of investigation, this Criminal Original Petition is allowed with a direction to the respondent police to preserve the C.C.T.V footage of the fourth respondent police station,, dated 31.03.2024. There shall be no order as to costs.
