ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondent to conduct survey and demarcation of the petitioner's land comprised in Old S.F. No.29/11, New S.F. No.29/80 to an extent of 4 Ares situated at Periyar Nagar, Pudukkottai North Revenue Village, Pudukottai Taluk, Pudukottai District.
2. The petitioner submitted that the land comprised in Old S.F. No. 29/11, New S.F. No. 29/80, to an extent of 4 Ares, is classified as Natham land. The petitioner has been in continuous possession and enjoyment of the property. The Special Tahsildar issued a Natham patta in favour of the petitioner under the Natham Settlement Scheme, dated 15.10.1994. Thereafter, the petitioner has been in possession and enjoyment of the property without any interruption. Hence, the petitioner is seeking to survey and demarcate the land.
3. The contention of the petitioner is there are no rival claims in respect of the property. Therefore, this Court is directing the respondent to consider the petitioner's online application dated 20.12.2024 and conduct a survey and demarcate the property in accordance to law. If the respondent requires police protection, the same shall be provided by the jurisdictional police station. The official respondents shall adhere to the following Standard Operating Procedures: 2/4
• The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.
• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
