PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to issue a direction to direct the 2nd respondent to give adequate police protection to the life and limb of the petitioner on the basis of the petitioners complaint dt. 23.02.2026 and 27.02.2026 and pass such other or further orders. 1/4

ORDER

The present petition has been filed seeking direction to the 2nd respondent police to give adequate police protection to the life and limb of the petitioner on the basis of the complaint lodged by the petitioner dated 27.02.2026.

2. A perusal of the records reveals that the petitioner had borrowed a loan from the 3rd respondent bank. The learned Counsel appearing for the 4th respondent alleges that he had entered into a sale agreement and paid a sum of Rs.90,00,000/-. The petitioner is stated to have cleared the loan with the 3rd respondent bank; however, he is refusing to execute the sale deed in favour of the 4th respondent. Hence, the 4th respondent has lodged a complaint before the 2nd respondent police.

3. According to the learned Counsel appearing for the petitioner, the petitioner is being threatened by the 4th respondent. 2/4

4. The learned Government Advocate (Criminal Side) appearing for the 2nd respondent submitted that the complaint against the petitioner has been closed, and the parties have been directed to approach the competent Civil Court.

5. In such circumstances, this Court is of the considered opinion that it is always open to the parties to approach the competent Civil Court on the basis of the sale agreement. In view thereof, this Criminal Original Petition stands closed. In case of any specific threat from the 4th respondent, the petitioner is at liberty to approach the concerned police authorities. 01.04.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn 3/4
