PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents particularly the 2nd respondent to consider the petitioner's representation dated 01.06.2020 having been submitted for the cancellation of the name of the 3rd respondent in the UDR Patta bearing No.2230 in respect of the property bearing old Survey No.74/8, New Survey No.313/12, situated at Mukkudal Village, Cheranmahadevi Taluk, Tirunelveli District by fraudulent act on the basis of fabrication of document on merits and in accordance with law and subsequently dispose of the same within a time frame as specified by this Court.

ORDER

This Writ Petition is filed to direct the 2nd respondent to remove the name of the 3rd respondent in the UDR Patta bearing No.2230 in respect of the property bearing old Survey No.74/8, New Survey No.313/12, situated at Mukkudal Village, Cheranmahadevi Taluk, Tirunelveli District and to issue patta in favour of the petitioner for the aforesaid property.

W.P.(MD)No.9546 of 2020 2.According to the petitioner, with the relief sought for in the prayer, he made a representation dated 01.06.2020 to the 2nd respondent. So far, no action has been taken by the 2nd respondent. Hence, the petitioner is before this Court.

3.The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the District Revenue Officer is the competent authority for making necessary changes in the UDR patta. In the case on hand, though the petitioner made a representation dated 01.06.2020, to the 2nd respondent, he did not submit any representation before the District Revenue Officer. 4.Recording the submission made by the learned Additional Government Pleader, this Writ Petition is disposed of with a direction to the petitioner to make fresh application before the District Revenue Officer concerned to workout his remedy, if he is so advised. No costs.
