ORDER : The Court made the following order :- The petitioner/Accused No.1, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 379 IPC r/w 21(5) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.205 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The learned Government Advocate (Crl. Side) would submit that the petitioner had earlier filed an application seeking anticipatory bail in Crl.O.P.(MD).No.5042 of 2022 and the same was dismissed by this Court on 23.03.2022.

CRL OP(MD). No.8897 of 2022 3.Since, the petitioner herein had earlier filed CRL.OP(MD). No.5042 of 2022 seeking anticipatory bail before this Court and the same was dismissed by this Court, this Court is not inclined to entertain the second anticipatory bail application. It is open for the petitioner to move anticipatory bail application before the same Court, which dismissed the earlier anticipatory bail application.
