ORDER

The petitioner has filed this Writ Petition seeking a Writ of Mandamus to direct the respondents No. 1 to 3 herein to pay the terminal benefits of the petitioner as represented by him through his representation, dated 04.12.2020.

2. Heard Mrs.Chamundi Bose, learned counsel for the petitioner and Mr.C.Godwin, learned counsel for the respondents. 2/6

3. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

4. The petitioner while working as a Record Clerk at the third respondent LIC Office has been removed from service in the year 2016. The claim of the petitioner is that his eligible terminal benefits have not been paid so far and hence, the present Writ Petition has been filed.

5. The learned counsel for the respondents submitted that the petitioner has got some liabilities and hence, he has not been settled with any benefits so far.

6. Whatever may be the liabilities of the petitioner, some order ought to have been passed by the respondents stating that why or how much of the retirement benefits, the petitioner is entitled to.

Since the petitioner has already been given a representation requesting the third respondent to disburse the terminal benefits and at-last he has also given a representation on 04.12.2020, the respondents ought to have considered and pass appropriate orders either by allowing or disallowing or limiting as the case may be.

8. In view of the above, this Writ Petition is disposed of with a direction to the respondents to pass orders on merits and release whatever eligible amount in response to the representation of the petitioner dated 04.12.2020 within a period of four weeks from the date of receipt of a copy of this order.
