PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to consider the petitioner representation dated 10.12.2022 and to regulate the traffic and allot separate parking places for all respondents in front of Arulmigu Natchiyar (Andal) Sametha Ranga Mannar Temple in east car Street at Srivilliputhur For Petitioner : M/s.J.Jeyakumaran Advocate.

The Writ Petition has been filed in the nature of a mandamus seeking a direction to the first respondent, District Collector, Virudhunagar, to consider a representation given by the petitioner on 10.12.2022, by which, the petitioner seeks regulation of traffic and allotment of separate parking places in front of Arulmigu Natchiyar (Andal) Sametha Ranga Mannar Temple in East Car Street, Srivilliputhur.

2. The writ petitioner claims that he is residing at Old No.23, New No.85, East Street, Srivilliputhur, Virudhunagar District. He was employed as a Sub Post Master at Sivakasi and had retired from service in the year 2018. The petitioner had the benefit of being a public servant and enjoying the salary out of money paid as taxes by the general public. He could very well spend his retirement time, in going over to children's home and teaching children some education or going over to senior citizen's home and spending time with those who are not as fortunate as the petitioner herein and who are forced to stay in old age homes. The petitioner however, has thought it fit that he should file the present writ petition seeking regulation of traffic at East Car Street at Srivilliputhur.

If he finds that the traffic is of discomfort to him, then he may vacate the house, sell the house and move over to some other place. He cannot give a representation and seek that every representation given by him should be considered by the revenue authorities or by the Collector. The petition is misconceived. The petitioner merely because he had been a government servant earlier, cannot expect that other public servants should answer to all his representations.

3. This Writ petition stands dismissed. Costs of Rs.10,000/- (Rupees Ten Thousand only) is imposed on the petitioner herein, to be paid to the District 3/6

Legal Service Authority, Virudhunagar at Srivilliputhur and the Chairperson of the District Legal Service Authority, should ensure that the costs are paid on or before 15.07.2023. The Chairperson must ensure that the costs are paid, and if not paid, must issue a report to the first respondent/ District Collector, Virudhunagar, who may initiate necessary revenue recovery proceedings against the petitioner to pay the costs.
