2.This Court by an order dated 08.04.2026 had directed the Additional District and Sessions Judge, Virudhunagar to number the application after setting aside the docket order.

3.According to the learned counsel appearing for the petitioner, the docket order has been filed before this Court in Crl.R.C.Sr.No.5388 of 2025 and the same was dismissed by this Court on the ground of maintainability. Thereafter, the present petition has been filed. 4.According to the learned counsel for the petitioner, instead of numbering the same petition, he may be permitted to file a fresh application. 5.Considering the above said facts, Paragraph No.4 of the order shall be substituted as follows:

"4.Considering the above said facts, the docket order in unnumbered Crl.M.P.No. of 2025 in Crl.A.No.160 of 2025 stands set aside and the learned Additional District and 1/3

Sessions Judge, Virudhunagar is directed to entertain a fresh application for the same relief. In case, if it is filed by the petitioner, dispose of the same on merits and in accordance with law."

5. A fresh order copy may be issued by the Registry. 16.04.2026.
