ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 08.03.2016 for the offences punishable under Sections 147, 148, 342, 449, 307, 302 and 506(ii) I.P.C. in Crime No.76 of 2016, on the file of the respondent police, seek bail.
2. Heard the learned Counsel for the petitioners and the learned Government Advocate (Crl.Side) appearing for the State.
3. The learned Counsel for the petitioners submitted that this is the second bail application and the petitioners are under judicial custody for more than 70 days.
4. The learned Government Advocate (Crl.Side) submitted that totally there are nine accused and the petitioners are arrayed as A.1, A.4, A.5, A.6 and A.8 and the investigation is pending.
5. Taking into consideration the fact that the petitioner is under judicial custody for more than 70 days i.e after the statutory period of the accused, this Court is inclined to grant bail to the https://hcservices.ecourts.gov.in/hcservices/
petitioners. Accordingly, the petitioners are ordered to be released on bail, subject to the following conditions: (i) Each of the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Sivagangai;
(ii) the petitioners shall appear before the trial Court daily at 10.30 a.m. until further orders;
(iii) the petitioners shall not tamper with evidence or witness either during investigation or trial.
(iv) the petitioners shall not abscond either during investigation or trial.
(v) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560] sd/- 19/05/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
