ORDER : The Court made the following order :- The petitioners/accused, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 of IPC r/w.4(1)(1A) and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.04 of 2021, seeks anticipatory bail.

2. This is the second anticipatory bail petition and the earlier petition was dismissed by this Court on 08.02.2021 in Crl.O.P(MD) No. 1697 of 2021 on the ground that the investigation is pending and if he granted anticipatory bail it would affect the on going investigation.

3. Since dismissal of the earlier petition there is no change in circumstances of the case to consider the present petition, hence this Court is not inclined to grant anticipatory bail to the petitioner.
