Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, forbearing the respondents 1 to 4 from permitting setting up of new petrol pump retail outlet at T.S.No.10 of Ward Ward AV Block 3, Santhosh Nagar, Wireless Station Road, Airport, For Petitioner : Mr.K.S.Karthiravan For Respondents : Mr.K.Balasubramani, Spl. Government Pleader for R1 to R3.

ORDER

Heard the learned counsel for the writ petitioner and the learned Special Government Pleader for the respondents 1 to 3. 2.The petitioner wants this Court to restrain the official respondents from permitting the setting up a new petroleum retail outlet at the petition mentioned place. This Court cannot anticipate that the official respondents would act contrary to law. An official respondent cannot be restrained from discharging his statutory functions. If any decision that is not agreeable to the petitioner is taken, the petitioner can move this Court at the appropriate time challenging the same. If any decision is taken in this regard, the second respondent will communicate copy of the same to the petitioner immediately and without delay 2/4

so that the petitioner can approach this Court for appropriate relief. I make it clear that I have not gone into the merits of the matter. All the contentions of the petitioner are left open.

3.With this liberty to the petitioner and direction to the second respondent, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
