O RDER This petiton is filed seeking direction to give adequate Police protection to the petitioner and his family members on the basis of the complaint cum representation dated 08.04.2023.
2. It is submitted by the learned counsel for the petitioner that there is threat from the unofficial respondents in respect of the dispute and immovable property, thereby filed a complaint before the respondents Police, however no protection is offered so far.
3. The learned counsel appearing for the respondents No.3 to 5 submits that the respondents No.3 to 5 are in possession of the property, which is claimed by the petitioner and rent are being collected by them. With help of Police, the petitioner intended to evict respondents No.3 to
5. Therefore, he appose the relief sought for.
4. It is also submitted by the learned counsel for the respondents No.3 to 5 that in the complaint made by them, a case has been registered against the petitioners in Crime No.533 of 2021 for the offences under Section 4 of Exorbitant Interest Act, 294(b), 506(ii) IPC and the 2/4
investigation is still pending.
5. The learned Government Advocate (Crl. Side) submits that petitioner has not submitted any complaint in person before the 2nd respondent Police Station. What all, the respondent Police have received an application through online without signature, are pending with them.
6. This Criminal Original Petition is disposed of, directing the petitioner to approach the respondent Police and file a fresh application in case of any threat from unofficial respondents or others. On filing of such application, the respondent Police are directed to dispose the same by following due process.
