Complainant Prayer : This Criminal Revision has been filed under Section 397 r/w. 401 of Criminal Procedure Code, to call for the records pertaining to order passed in Cr.M.P.No.340 of 2023 in Crl.A.No.12 of 2023 on the file of the learned Principal Sessions Judge, Thanjavur dated 23.01.2023 and set aside the condition imposed on the petitioner to deposit Rs.2 Lakhs alone. O R D E R

This Criminal Revision is directed against the order passed in Crl.M.P.No. 340 of 2023 in C.A.No.12 of 2023 dated 23.01.2023.

The petitioner/accused has preferred an appeal challenging the judgment of conviction passed in S.T.C.No.153 of 2021 dated 08.12.2022 before the Principal Sessions Court, Thanjavur, in C.A.No.12 of 2023 along with an application in Crl.M.P.No.340 of 2023 for suspension of sentence. The learned Principal Sessions Judge, while suspending the sentence, has directed the petitioner to deposit 20% of the compensation award which comes to Rs.2,00,000/- (Rupees Two Lakhs only) within 30 days from the date of that order. Aggrieved by the above condition, the present revision came to be filed.

3. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that the petitioner may be granted two installments to pay the amount as directed by the learned Principal Sessions Judge.

Considering the above facts and circumstances and also taking note of the fact that the learned Principal Sessions Judge has imposed the condition by directing the petitioner to deposit the minimum amount as contemplated under Section 148(2) of Negotiable Instruments Act, this Court is not inclined to interfere with the quantum of the amount imposed by the learned Principal Sessions Judge. But at the same time, taking note of the submission made by the learned counsel appearing for the petitioner, the petitioner is permitted to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) before the trial Court within a period of 7 days from today (17.04.2023) and thereafter deposit the remaining amount within a period of two weeks thereafter.

5. With the above modification, this Criminal Revision Petition is disposed of.
