O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the first respondent to grant 28 days of ordinary leave without Police escort to the petitioner's husband, who is a life convict, presently serving sentence at Central Prison, Trichy.

2. When the matter was taken up for hearing today, the learned Additional Public Prosecutor produced a copy of the proceedings of the first respondent, dated 30.03.2026. On going through the same, it is clear that ordinary leave has been granted for 28 days to the detenue with Police escort.

3. The learned counsel for the petitioner submitted that on two earlier occasions, the detenue was granted ordinary leave and emergency leave. The learned counsel further submitted that ordinary leave has been sought in order to attend to the ailment suffered by the petitioner and also to arrange funds to repair the house. Therefore, it was submitted that the condition imposed by providing for escort may be modified.

4. Taking into consideration the facts and circumstances and considering the reason, for which, the ordinary leave has been sought and also taking note of the fact that the detenue was earlier granted ordinary leave and emergency leave and that the detenue complied with the conditions and nothing untoward took place, we are inclined to modify the condition imposed by the first respondent by directing the detenue to report before the 4th respondent daily at 6.00 p.m. during the entire period of ordinary leave. Apart from that condition, the detenue is permitted to submit the sureties before the Superintendent of Prison, Central Prison, Trichy, instead of executing the sureties before the Tahsildar, and the two sureties shall be family members of the detenue.

5. This Writ Petition (Criminal) is disposed of with the above directions. No costs.
