CORAM:
THE HONOURABLE MR.JUSTICE G.ILANGOVAN Crl.O.P.(MD)No.7873 of 2021 Joseph Selvaraj ... Petitioner/Complainant Vs.
Titus Samuel ... Respondent/Accused PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the Fast Track Judicial Magistrate, Tuticorin, to dispose of C.C.No.102 of 2018 pending on its file, within the time frame fixed by this Court.
For Petitioner : Mr.S.Ramesh
ORDER
This petition has been filed seeking a direction to the Fast Track Judicial Magistrate, Tuticorin, to dispose of C.C.No.102 of 2018 pending on its file, within the time stipulated by this Court. 2.According to the petitioner, even though the accused admitted the offence punishable under Section 138 of the NI Act, on 04.08.2018 itself, the proceedings is not concluded and the trial is dragging on, due to the absence of the concerned Judicial Officer. It is also submitted by the learned counsel for the petitioner that the learned Principal District Magistrate, Tuticorin, is holding the additional charge of the Fast Track Court, Tuticorin. 3.Since the accused himself admitted the offence, keeping the matter pending for more than three years is not appreciable.
Hence, there shall be a direction to the learned Principal District Magistrate, Tuticorin, who is holding the additional charge of the Fast Track Court, Tuticorin, for expeditious trial of the case in C.C.No.102 of 2018 to conclude the proceedings and dispose of the same on merits and in accordance with law, within a period of two months from the date of resumption of regular work in subordinate Courts in view of the present pandemic situation. 4.With the above direction, this Criminal Original Petition is disposed of.
