ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 of I.P.C. in Crime No.242 of 2013 seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is an Administrative personality in the Management of Hindu temple and he started a small scale savings scheme and also chit business. On the representation of the petitioner, the defacto complainant and his brother have deposited a sum of Rs.18 lakhs and above and thereafter, he found absconded and failed to repay the deposit amount. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the crime is of the year 2013 and also, he is an innocent person and he has been falsely implicated in this case and sought for anticipatory bail.

4.The learned Additional Public Prosecutor would submit that the petitioner cheated and misappropriated amount of more than Rs.18 lakhs from the general public and hence, he vehemently opposed the grant of anticipatory bail.

3.It is seen from the records that the petitioner had already filed anticipatory application before this Court in Crl.O.P(MD) No.14541 of 2014 and the same was dismissed on 05.08.2014 and again, he filed another application in Crl.O.P.(MD) No.3578 of 2017 and the same has also been dismissed by this Court on 17.01.2018. Since the amount involved in this case is more than Rs.18 lakhs and the petitioner has cheated the general public, this Court is not inclined to grant anticipatory bail to the petitioner. 4.Accordingly, this criminal original petition is dismissed. sd/- 29/10/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
