For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No. 361 of 2020 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner is a sole accused apprehending arrest at the hands of the respondent police for the offence punishable under section 379 of IPC, in Crime No.361 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner said to have stolen the two wheeler of the defacto complainant bearing registration No.TN-64-K-8354. Hence, a complaint has been registered.
3. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (criminal side).
4. The learned counsel appearing for the petitioner would submit he is an innocent person and he did not commit any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5. The learned Government Advocate (criminal side)appearing for the respondent police would submit that the petitioner is a sole accused and that the petitioner is a habitual offender and that there are 12 previous cases are pending against the petitioner in similar offence.
6. Taking note of the submission of the learned Government Advocate (criminal side) and considering the fact that the petitioner is a habitual offender and 12 previous cases are pending against the petitioner and in this stage, if the petitioner will be released on bail, there is a chance to commit further crime in similar offence and hence, this Court is not inclined to grant anticipatory bail.
7. Accordingly, the Criminal Original Petition stands dismissed.
