O R D E R

(Order of the Court was made by G.R.SWAMINATHAN, J.) The petitioner's grievance in this writ petition is that the site earmarked for public purpose in V.O.C. Nagar comprised in S.No.1039/2 part in Melmangalam Village, Vadugapatti in Periyakulam Taluk in Theni district was encroached upon by the fifth respondent promoter himself.

2.The learned counsel for the fifth respondent stated that the fifth respondent is no more.

3.The learned Additional Government Pleader would state that the competent authority to remove the encroachment is the jurisdictional Tahsildar. The said authority is not a party to the writ petition.

4.We therefore direct the petitioner to submit a comprehensive representation to the competent authority for removal of the encroachment in question. The competent authority, on receipt of such representation, shall take action for removal of the encroachment after due notice to the interested parties. Such exercise shall be completed within a period of three months from the date of receipt of representation.

5.The writ petitiion is disposed of with the above direction. No costs.
