ORDER
This petition has been filed seeking to direct the learned III Additional Sessions Judge (PCR Court), Madurai, to consider the petitioner bail application in Crime No.22 of 2018 on the file of the second respondent police on the same day of his surrender. 2.The learned Government Advocate (criminal side) express his serious objection stating that the offences are involved under Sections 417 and Section 3(2) (va) of Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. He would further submit that the victim is also pregnant by six months. https://hcservices.ecourts.gov.in/hcservices/
3. In view of the above, the learned III Additional Sessions Judge (PCR Court), Madurai shall take into consideration all these aspects and the merits of the case and pass orders on merits and in accordance with law. This order does not be that there should be a positive order.
4. In due compliance of Section 15-A of the SC/ST Act, the petitioner shall serve advance notice of surrender and bail two clear days before the intended date of surrender enclosing additional copies on the Special Public Prosecutor of the concerned Court and the Special Public Prosecutor shall intimate it to the defacto complainant through the respondent police. 5.With this observation, this Criminal Original Petition stands closed.
