ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the second respondent to forthwith conduct a survey, demarcate and fix the boundaries of the petitioner's property, and thereafter effect subdivision of the said property for issuance of a separate patta in respect of the land comprised in Survey No.349/4B2, measuring an extent of 131.5 ares, under Joint Patta No.2536, situated at Vaiyyampatti Village, Manaparai Taluk, Trichy District, based on the petitioner's representation dated 09.03.2026.

2. Originally, the land belonged to the petitioner's father-in-law, namely Karuppasamy, as his ancestral property. Upon his demise, his legal heirs, namely his wife Poochammal and his son Nallusamy, succeeded to the estate and were in continuous possession and enjoyment of the property. Subsequently, the petitioner's husband and mother-in-law sold the same for valid consideration, an extent of 131.5 ares to the petitioner through a sale deed dated 28.07.2018. Thereafter, the petitioner has been in lawful possession and enjoyment of the same. The petitioner submitted an online application on 09.02.2023 for conducting a survey and fixing the boundaries. The petitioner intends to subdivide the land and obtain a separate patta. Since the same has not been considered, the present Writ Petition has been filed.

3. The learned counsel appearing for the respondents submitted that the petitioner had submitted the online application as early as 09.02.2023 and that the same would be considered. The said statement is recorded.

In view of the above, this Court is directing the first respondent to consider the petitioner's online application dated 09.02.2023 and conduct a survey and demarcate the property with the assistance of the second respondent and also consider issuance of patta in accordance with law. If the first respondent requires police protection, the same shall be provided by the jurisdictional police station. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 3/5

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
