ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 02.04.2025 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) praying to grant bail.

The petitioner / A1 was arrested and remanded to judicial custody on 13.01.2025 for the alleged offences punishable under Sections 109, 115(2), 126(2), 127 (2), 191(2), 191(3), 296(b) and 351(3) of Bharatiya Nyaya Sanhita (BNS), 2023 altered into Sections 191(2), 191(3), 126(2) 296(b), 115(2), 118(1), 109, 351(3) and 103(1) of Bharatiya Nyaya Sanhita (BNS), 2023 in Crime No.10 of 2025 on the file of the respondent-police.

The case of the prosecution is that on 01.01.2025, the deceased Mohan and defacto complainant reprimanded A1 for reckless bike riding, due to this incident, on 12.01.2025, at about 09.45 p.m., the petitioner along with other accused persons waylaid the defacto complainant and Mohan and abused them in filthy language, attacked them and trampled on them. Due to the above incident, Mohan died in the Hospital on 15.01.2025. Hence the case.

Mr.S.Sathya Chidambaram, the learned counsel appearing for the petitioner submits that the petitioner did not commit any offence as alleged by the prosecution and that he has been falsely implicated in this case. He further submits that the petitioner has been in judicial custody since 13.01.2025. He however submits that the petitioner is ready to abide by any condition to be imposed by this Court. He therefore prays to grant bail to the petitioner.
5. Mr.R.Meenakshi Sundaram, learned Additional Public Prosecutor appearing for the respondent-police, submits that the investigation is yet to be completed. He further submits that due to the offence committed by the petitioner and other accused persons, one Mohan died and the defacto complainant sustained injury and was admitted in the Hospital and discharged on the same day. He further submits that the petitioner has no previous case. However, he prays to dismiss this Criminal Original Petition.
6. Heard on both sides. This Court has perused the records including the First Information Report.

7. The overt act against the petitioner is that he attacked the deceased by using knife and caused an injury in the stomach (vital part of the body). Further, deceased admitted in hospital on 12.01.2025, succumbed to his injuries on 15.01.2025, whereas, the defacto complainant also got injured in the incident and he was admitted in the Hospital on 12.01.2025 and discharged on the same day. In view of the overt act allegedly committed by the petitioner and in view of the fact that investigation has not been completed, at this stage, if bail is granted to the petitioner, it would jeopardize the investigation and also he will cause threat to the witnesses. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
