PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the Principal District and Sessions Court, Special court of exclusive trial of cases under SC/ST(POA) cases, Pudukkottai, to consider the bail application of the petitioner on the same day of his surrender in Crime No. 62/2026 on the file of the 2nd respondent police. 1/4

ORDER

The present petition has been filed by the sole accused in crime No.62 of 2026 on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of his surrender.

2. Considering the averments in the petition, there shall be a direction to the Principal District and Sessions Court, Special Court of exclusive trial of cases under SC/ST(POA) cases, Pudukkottai, to consider the bail application of the petitioner on the same day of his surrender in crime No.62 of 2026 on the file of the second respondent police after giving due opportunity to the defacto complainant.

3. With the above said observations, this Criminal Original Petition stands allowed.
