ORDER : The Court made the following order :- The petitioner /Sole Accused, who was arrested and remanded to judicial custody on 1/6
16.10.2024 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 22(c) and 25 of NDPS Act, 1985, in Crime No.12 of 2024 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 15.10.2024 at about 22.15 hours, based on the secret information received by the Sub Inspector of Police, he along with police party went to the occurrence place, at that time, the respondent Police found that the petitioner was in illegal possession of 25 kgs of Cheras and 5 kgs of Kettamain. Hence, the case.
3. The learned counsel for the petitioner would contend that the respondent police have registered a false case against the petitioner for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 22(c) and 25 of NDPS Act, 1985. The petitioner is an innocent and he is nothing 2/6
to do with the alleged offences. He would further contend that no contraband was recovered from the petitioner. He is in judicial custody from 16.10.2024. Therefore prayed to grant bail to the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that this case was registered as against the petitioner and others for the illegal transportation of 25 kgs of Cheras and 5 kgs of Kettamain, which are commercial quantity. The petitioner has no previous cases. He would further submit that the petitioner was in conscious possession of contraband at the time of arrest. He would further submit that the investigation has been completed and charge sheet has also been filed and the same was taken on file in C.C.No.133 of 2025 by the learned II Additional District Judge for NDPS Act Cases, 3/6
Madurai, and the offences are grave in nature and hence, he strongly opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.

Considering the rival submissions made on either side, considering the fact that the quantity of contraband involved in this case is a commercial quantity and the petitioner was in conscious possession of contraband at the time of arrest and the investigation has been completed and charge sheet has also been filed and the same was taken on file in C.C.No.133 of 2025 by the learned II Additional District Judge for NDPS Act Cases, Madurai, hence, this Court is declined to grant bail to the petitioner at this stage.

Accordingly, the Criminal Original Petition is dismissed.
