Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Declaration declaring that the proceedings issued by the 4th respondent/Advocate Commissioner dated 16.04.2025 and 29.04.2025 as null and void and illegal and consequently quash the said proceedings and pass such other orders as this Honoourable Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The writ petition is filed for a declaration of the proceedings issued by the 4th respondent / Advocate Commissioner dated 16.04.2025 and 29.04.2025.

2. Heard Mr.B.Jameelarasu, learned counsel appearing for the petitioner, Mr.M.Sarangan, learned Additional Government Pleader, who takes notice on behalf of the respondents 1 to 3, Mr.R.Shankar Ganesh, learned Advocate Commissioner and M/s.B.Bhuvaneshvari, learned counsel, who takes notice for R5, R7 & R9.

3. Upon hearing the learned counsel appearing for the petitioner and upon perusing the material records of the case, it can be seen that an Advocate Commissioner was appointed by an order dated 04.10.2024 in W.P.(MD) No.16291 of 2023 and etc.,. Therefore, even assuming that, according to the petitioner, any action of the Advocate Commissioner is liable to be questioned or that the Advocate Commissioner is acting beyond the scope of the appointment, the appropriate course open to the

petitioner is to bring the same to the notice of the very same Court in the matter in which the Advocate Commissioner was appointed.

4. Accordingly, the petitioner is directed to file a miscellaneous petition in the very same W.P.(MD) No.16291 of 2023 and etc.,. In view of the above, the present writ petition cannot be entertained.

5. With the above liberty, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 02.04.2026 rgm
