ORDER

The present writ petition has been filed to challenge the rejection order in Na.Ka.No.06/MELUR CIRCLE/2025 dated 26.03.2025 passed by the 2nd respondent and quash the same and to direct the respondents to grant permission and protection for conducting Adal Padal Program scheduled to be held on 06.04.2025 at 06.00 p.m., to 10.00 p.m., in connection with Thiruvizha Arulmigu Shri Thottichi Amman Thirukovil, Chokkampatti Village, 11th Ward, Melur Taluk, Madurai District.

According to the petitioner, he is a member of festival Committee and the villagers have decided to conduct festival from 06.04.2025 to 08.04.2025 at Thiruvizha Arulmigu Shri Thottichi Amman Thirukovil, Chokkampatti Village and during the festival, they have decided to conduct Adal Padal programme on 06.04.2025 from 06.00 p.m., to 10.00 p.m. In this regard, they have sent representation to the 2/6

respondents on 16.03.2025 and the same was rejected by the 2nd respondent on 26.03.2025 by citing law and order problem. The respondent police without giving any valid reasons, simply rejected the request of the petitioner, on the ground of law and order problem. Hence, it is liable to quashed.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner has sent a representation to conduct Adal Padal programme on 06.04.2025 from 06.00 p.m., to 10.00 p.m., at Thiruvizha Arulmigu Shri Thottichi Amman Thirukovil, Chokkampatti Village and the same was rejected on the ground of law and order problem on 26.03.2025. Since the representation of the petitioner was already considered, this petition is liable to be dismissed.

4.This Court heard learned counsels on both sides and perused the materials available on record.

5.The contention of the petitioner is that the villagers have decided to conduct Adal Padal programme on 06.04.2025 from 06.00 p.m., to 10.00 p.m., at Thiruvizha Arulmigu Shri Thottichi Amman Thirukovil, Chokkampatti Village and for that they have sent a representation to the 2nd respondent and the same was rejected. According to the respondent police, due to law and order problem, they have rejected the request of the petitioner.

6.Since Adal Padal programme is only a cultural programme, the 2nd respondent cannot reject the request of the petitioner simply by citing the reason of law and order problem. Therefore, the impugned order, dated 26.03.2025 is liable to be set aside. 7.Accordingly, this Court hereby set aside the impugned order, dated 26.03.2025 and direct the 2nd respondent to grant permission to the petitioner to conduct Adal Padal programme on 06.04.2025 from 06.00 p.m., to 10.00 p.m., at Thiruvizha Arulmigu Shri Thottichi Amman Thirukovil, Chokkampatti Village, Madurai District. The respondents 1 and 2 are directed to monitor the entire programme and provide adequate 4/6

police protection and the petitioner is also directed to conduct the event without any law and order problem and without praising any particular community people and without any obscene acts. 8.With the above said observations and directions, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed.
