For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-To enlarge the petitioner on anticipatory bail in the event of his arrest in pursuant to the non bailable warrant issued in connection with in PRC.No.9 of 2013 pending on the file of the learned Judicial Magistrate No.II, Virudhunagar. ORDER : The Court made the following order :- The petitioner / second accused, apprehends arrest in connection with the Non-Bailable Warrant (NBW) issued on 22.06.2019 in P.R.C.No.9 of 2013 on the file of the Judicial Magistrate No.II, Virudhunagar. Since the NBW is pending from the year 2019 onwards, it could not be appropriate to grant anticipatory bail to the petitioner.

2.However, the petitioner may be granted liberty to file an application to recall the warrant with a direction to the Trial Court to consider the same on the same day of filing the application.

3.Accordingly, the petitioner herein is granted liberty to file an application to recall the warrant before the Trial Court in P.R.C.NO.9 of 2013.
