2. Respondents 1 to 3 have been served and their names are printed in the cause list. Notice sent to 4th respondent has been returned with an endorsement 'no such person'.
3. Learned counsel for the petitioner / appellant would submit that the 4th respondent is the owner of the vehicle and therefore, notice may be dispensed with. Hence, notice to the 4th respondent is dispensed with.
4. Being satisfied with the reasons stated in the supporting affidavit, delay is condoned and this petition is allowed.
Registry is directed to number the appeal, if the papers are otherwise in order.
