For Anticipatory Bail in Crime No.62 of 2021 on the file of the Respondent Police.
ORDER: The Court made the following order :
Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 6(4) of TNSC (RDCS) Order r/w 7(1)(a)(ii) of Essential Commodities Act in Crime No.62 of 2021 on the file of the respondent police, seeks anticipatory bail.
3. The earlier Criminal Original Petition was dismissed on merits by this Court on 21.05.2021. The present Criminal Original Petition came to be filed by stating the change of circumstances https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD. No.7974 of 2021 that the petitioner is affected by COVID-19 and the plea has been made on the medical ground.
4. The learned Additional Public Prosecutor (Criminal side) submitted that the petitioner is having four previous cases, which are similar in nature and the quantity involved in the crime is also huge. But however, I am not going into the merits of the case. Since the petitioner is affected with COVID-19 on medical grounds, interim Anticipatory Bail for a period of one month is granted and orders will be passed after the expiry of one month on merits. Accordingly, petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Uthamapalayam, Theni and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
